1. What Nouhata is

Nouhata is a marketplace where independent sellers - individuals and businesses - list items for sale at a fixed price, by auction, or both. Nouhata is not the seller of items listed by sellers.

2. Accounts

You must give accurate information and keep your password secret. You are responsible for everything done with your account. We may suspend accounts that break these terms.

3. Buying

Buying at a fixed price, or placing the winning bid when an auction ends, is a commitment to buy. You pay Nouhata, by one of the methods offered for your country, within 3 days. Nouhata holds your payment. The process of paying the seller starts only after you confirm you received the item and the time in which you could return it or dispute the order has passed, so your right to a refund is never cut short by the seller having already been paid. If the item does not arrive or is not as described, contact Nouhata before you confirm receipt.

You may cancel an order until it has been shipped. Once the seller has marked it shipped it cannot be cancelled. Each listing states its return window, counted from the day of sale; a return requested within that window is handled between you, the seller and Nouhata, and a return requested after the window has passed is not accepted. A listing marked non-refundable (final sale) takes no returns. A free give-away item costs nothing: you choose on the order page whether to collect it in person, at the place and time the seller gives you, or to have it shipped to your address. Collecting it costs nothing at all. Asking for it to be shipped means paying the seller's shipping charge, which is shown before you choose and paid through Nouhata like any other payment; the parcel is sent once Nouhata has it. Either way the item itself is free.

A free item is not refundable and cannot be returned. There is no payment for it, so there is nothing to refund: no return window runs on a free item, the return request on the order page is not offered for one, and a seller is under no obligation to take it back. If it was shipped to you, the delivery charge you paid for the parcel is for carrying it and is not refundable either once the parcel is sent. A give-away is offered as it is, with no warranty and no promise of fitness or condition. The seller's only obligation is that the item is lawful to give away; by claiming a free item you accept it at your own risk and, to the fullest extent the law allows, waive any claim against the seller arising from it. When you order several items together, each item is its own order: it can be cancelled or returned on its own, and the others are not affected.

4. Selling

Opening a shop is free. Nouhata keeps a commission of 5% of the sale price on every sale, and pays you the rest to your payout account. The vendor payment process starts after the return date and the dispute date have both expired, not when the buyer confirms receipt; Nouhata holds your money until then. A return or a dispute that is still open keeps it held until that is settled, and an order that is refunded is not paid out at all. Fees may change; changes apply to sales made after they are announced on the fees page.

You must own what you sell, describe it honestly, ship it promptly once Nouhata confirms the buyer's payment, and not ask buyers to pay you outside Nouhata. Listings of illegal, stolen, counterfeit or dangerous goods are removed and the account closed.

5. Collecting an item in person

A buyer may collect an item from a seller instead of having it shipped, and a free give-away is often collected. Nouhata is not present at that meeting, does not arrange it, and is not responsible for what happens at it. Both of you agree to the following.

Meet in a public place. A cafe, a shop, a shopping centre, a supermarket car park, the lobby of a police station. Do not go inside a stranger's home and do not invite one into yours to hand over an item. Tell somebody where you are going.

Nothing is paid in person. A free item costs nothing at all, and every payment for anything else goes through Nouhata. Anyone who asks you for money, a transfer or a code at the meeting is breaking these terms; walk away and tell us.

Where the pickup is not a public place, both of you must send a photograph of yourselves before the item can be marked handed over, and each of you is shown the other's, so you know who you are meeting. No identity document is asked for and none is kept. Separately, a seller getting an order ready may ask a buyer for a photograph whatever kind of place it is; the buyer may refuse, and refusing does not affect the order.

What happens to those photographs. One is shown to the other party to that one order and to nobody else. It is not offered as a download, every viewing is recorded, and it is deleted a short time after the pickup - 30 days unless we publish a different period. You may not save, copy, send on or publish a photograph you are shown, or use it for anything but recognising the person you arranged to meet. Doing so closes your account and may be a criminal matter.

Both of you also accept a short safety notice on the order before the handover. That acceptance is recorded with the time, as the record that you were warned.

6. Auctions

A bid cannot be withdrawn. An auction with a reserve price sells only if the highest bid reaches the reserve. Sellers may not bid on their own auctions.

7. Liability

Nouhata provides the marketplace as it is. To the extent the law allows, Nouhata is not liable for the quality, safety or legality of items, for losses arising from dealings between buyers and sellers beyond the amount Nouhata holds for the order in question, or for anything that happens at a meeting arranged between a buyer and a seller to collect an item.

8. Changes to these terms

These terms and the privacy policy are versioned. When we publish a new version you will be asked to accept it the next time you use Nouhata. Until you do, you can still sign in and read the site, but you cannot bid, buy, sell or be paid out. Orders and auctions already under way are not affected.
